Having allegedly attacked his ex-girlfriend in public, Lane Garrison could be facing time behind bars after the District Attorney’s Office announced he's charged the actor with one count of misdemeanor battery.

The "Prison Break" star is said to have engaged in a physical altercation with ex-girlfriend/Playboy Playmate Ashley Mattingly in the lobby of her Beverly Hills apartment last week and, when a witness approached the couple, Garrison took off.

And making matters worse, the “Prison Break” star was only six days away from fulfilling his parole sentence stemming from his manslaughter conviction back in 2006.

His life came to a standstill back in December of 2006 when he was involved in an alcohol-related car crash that killed a teen. And earlier this week Lane Garrison was released from jail to enter a rehab program.

The “Prison Break” actor was reportedly released early Wednesday (April 29) morning and picked up by family members who took him to Jessica Simpson’s family home in Encino.

Actor Lane Garrison, who played a convict on the hit TV show Prision Break, is about to get a real life close-up of the big house after being ordered in the custody of the California Department of Corrections for 90 days. This window of time was ordered by Judge Ellen Fox so that Lane can be evaluated by prison staff and psychiatrists, who will determine whether he is a suitable candidate for probation.

Today’s action comes after Garrison pleaded guilty to felony charges of vehicular manslaughter and drunken driving that stem from his deadly crash in December 2006. The incident happened after Lane attended a party at the request of some teenagers he met earlier in the day. Unfortunately, the day ended in tragedy when Vahagn Setian, a 17-year old female passenger, was killed as Lane crashed his SUV on the side of the road. Lane walked away from the crash with only minor scratches.

In a potential bid to lessen his sentence, former Prison Break actor Lane Garrison recently filmed a public service announcement against the dangers of drunk driving.

The drunk driving commercial, which was shot in a local park near his LA pad last Saturday, is chalked up to air nationwide later this month.

Lane Garrison just made the biggest mistake of his life, and there were several witnesses to record the account. TMZ spoke with many witnesses that claim they saw Lane snort lines of coke just before the fatal crash when he killed a 17-year-old boy in December, and blood tests have revealed that he was more than twice the legal limit and was under the influence of cocaine.

The Beverly Hills PD have recommended to the county prosecutor that Lane be charged with gross vehicular manslaughter. This felony charge can carry a maximum of 10 years in prison.
