Tuesday, November 10, 2009 David Letterman’s Blackmailer Wants Case Tossed
More details from David Letterman and the extortion case have been made public - and there is even more behind it. On Tuesday, arguments from an attorney for defendant Robert Halderman, the CBS producer accused of trying to blackmail the talk show host with details about his affairs with women he worked with, brought on new questions. Defense lawyer Gerald Shargel asked the New York judge to dismiss Halderman’s indictment, saying that his client wasn’t blackmailing anyone, but trying to make a “hard driven” deal to sell rights to a screenplay inspired by Letterman’s sexually-charged workplace. Shargel also announced that the prosecution’s case against the accused man “infringes on Halderman’s basic First Amendment right to author and/or sell book.” Halderman was arrested on October 1 for trying to extort $2 million from Letterman, threatening to spill information about his sexual affairs with female workers on Late Show. Documents released in court showed what Halderman’s attorney has called aggressive attempts to get a deal for a screenplay. Halderman felt “Letterman had created and fostered an environment of workplace sexual misconduct that under any definition amounted to actionable sexual harassment.” Halderman also found out this his girlfriend Stephanie Birkitt, had an affair with Letterman - the prosecution is arguing that his anger made it a plot of blackmail.
